What to do if FDA is closed

If you are transporting merchandise regulated by FDA there are a few things you need to be aware of when you arrive at your port of crossing.

1. Did the shipment get an automatic MAY PROCEED?
   Yes – no further action required by FDA-once processed by CBP,
                Proceed to destination.
    No – see #2 or #3, whichever is applicable
   
   
2. If FDA’s office is open, do not leave the border without presenting documents to them
   after you are processed by CBP.
   
   
3. If the FDA is not open because the driver arrives or will arrive at the border after FDA hours of operation-driver MUST leave copies of paperwork (with entry#) for FDA. Driver may deliver the goods to the consignee, but they must be kept intact at destination. Please call our office for a FDA Hold Intact Notice which must be given to the consignee.

Please note that the CBP officer at the booth is not responsible to notify the driver of the FDA release status of your goods. CBP will only advise of CBP clearance status, not the FDA status. It is the carrier/driver’s responsibility to know to go in the FDA office to update the clearance status.
